DUI Defense

The officer must have probable cause to stop you. Probable cause is established if you drive erratically, your car smokes, your lights are off, etc. The filed sobriety test must be done per guidelines, the blood/urine test to determine your alcohol content called BAC. In California, the limit on BAC is 0.08 of your weight.

DMV hearing scheduling must be made within 10 days of the date the citation is issued. At the hearing ask the officer to be present at the hearing. Examine the officer regarding the claims made in the citation, his/her training to do DUI stops, calibration of the breathalyzer, the qualification of the officer taking blood sample, the number of times the blood was taken, how the blood was taken, etc.
